The Judicial Inspection Department in the Public Prosecution of the State of Palestine reports to the Attorney General.

1. The legal framework regulating the Judicial Inspection Department

  • Supreme Judicial Council Resolution No. ( ) of (2021) regarding the regulations for judicial inspection of the work and members of the Public Prosecution.
  • Cabinet Decision issued on 4/27/2022 approving the system of judicial inspection of the work and members of the Public Prosecution No. (12) Of (2022) published in the Palestinian Gazette in Issue (192) dated 6/30/2022.
  • After reviewing the Judicial Authority Law No. (1) Of (2002) and Decree Law No. (40) Of (2020), especially the provisions of Articles (19), (20) and (28) thereof, and based on the powers granted to the Council under the Judicial Authority Law No. (1) of (2002) AD, especially Articles (80) and (42/2)
  • Judicial Inspection System for Public Prosecution Members Decree No. (12 ) of 2022

2. The department shall consist of the following

  • A few assistants to the Attorney General, the head of the department shall be the most senior by a decision issued by the Attorney General.

A sufficient number of inspectors.

A sufficient number of administrative staff.

  • The resolution contained in item (a) shall determine the serving terms of inspectors in the department and its head.

3. The Department shall undertake the following tasks

  • Conduct periodic and unannounced inspections of the work and personnel of the Public Prosecution at least once a year, including attending trial sessions where members of the Public Prosecution are present, preparing reports on these inspections, and submitting them to the Attorney General.
  • Prepare adequacy reports and assess the performance of members of the Public Prosecution.
  • Recommend disciplinary or criminal proceedings against any member of the Public Prosecution to the Attorney General.
  • Draft disciplinary regulations for violations committed by members of the Public Prosecution and present them to the Attorney General.
  • Receive and investigate complaints concerning the actions and conduct of members of the Public Prosecution.
  • Monitor the progress of prosecutions and offer any necessary recommendations to the Attorney General.
  • Undertake tasks assigned by the Attorney General.
